U.S. Army Pfc. Naser Jason Abdo, the man accused of planning a deadly bombing and shooting on Fort Hood soldiers, and who yelled out the name of accused Fort Hood killer Maj. Nidal Hasan during a court hearing on Friday, could spend 10 years in prison and be fined $250,000 if convicted of the plot.
The AWOL soldier was charged in a Texas court on Friday on suspicion of possession of an unregistered destructive device, according to the Los Angeles Times. He was also defiant during his first court appearance and refused to stand when he was asked to.
"Nidal Hasan - Ft. Hood 2009!" Abdo said of his fellow Army comrade and Muslim charged with killing 13 people at the base nearly two years ago.
USA Today has reported that federal investigators searched Abdo's Killeen, Texas motel room and found bomb-making equipment, including six bottles of smokeless gunpowder, shotgun shells, two clocks, spools of wire, an electric drill, two pressure cookers and an article titled "How to Build a Bomb in the Kitchen of Your Mom."

An AWOL soldier was arrested in Texas near Fort Hood after authorities found potential bomb-making materials and at least one gun in the suspect's motel room, a federal law enforcment official said.
Investigators said they believe the suspect was planning an attack on fellow soldiers near the military post, where an Army psychiatrist was charged two years earlier in the slayings of 13 people, said the federal law enforcement official, who was briefed on the matter, but not authorized to speak publicly.
Authorities were alerted to the suspect, identified as Pfc. Naser Abdo, 21, stationed at Fort Campbell in Kentucky, after he visited the same Killeen gun store where Army psychiatrist Maj. Nidal Hasan obtained a gun prior to the 2009 attack, said the official.
Greg Ebert, a former police officer who works at the Guns Galore shop, said Abdo acted suspiciously when he went to the store Tuesday afternoon to buy six pounds of gun powder.

Witnesses to a gunman's rampage at Fort Hood will begin describing the attack for a military officer Tuesday, providing new details about the scene that unfolded nearly a year ago in a processing center where soldiers were making final preparations to deploy.
The Article 32 hearing involving Maj. Nidal Hasan is expected to last at least three weeks and will determine whether there is enough evidence to put the Army psychiatrist on trial. Such hearings are unique to military court, where prosecutors and the defense can call witnesses, and both sides are able to question them and present other evidence.
Hasan, 40, is charged with premeditated murder and attempted premeditated murder in the Nov. 5 attack, which killed 13 people and wounded 32 others. It was the worst mass shooting at an American military base.
When the proceeding begins, Hasan will be sitting just a few feet from the witnesses.

FORT WORTH, Texas -- Military prosecutors sent a notice Wednesday indicating they plan to seek the death penalty against the Army psychiatrist charged in the deadly shooting rampage at Fort Hood, a defense attorney said.
Maj. Nadal Hasan is charged with 13 counts of premeditated murder and 32 counts of attempted premeditated murder in the Nov. 5 shooting. Premeditated murder carries the death penalty. But if military jurors convict Hasan, they can only sentence him to death if they determine there is an aggravating factor in the case, according to military law.
Defense attorney John Galligan said the notice he received from prosecutors outlines as an aggravating factor that more than one person was killed in the same incident.
"They've done everything except tell me to my face that they plan to seek the death penalty," Galligan told The Associated Press from his office near Fort Hood, about 130 miles (210 kilometers) southwest of Fort Worth.
Military prosecutors have not publicly said what punishment they plan to seek, and Fort Hood officials did not immediately return calls seeking comment Wednesday.
Richard Stevens, an attorney who defends military cases and is not involved in Hasan's case, said crimes that are ineligible for the death penalty do not require jurors to consider aggravating factors.
"The only reason to send a notice of aggravating factors is if you're trying to seek the death penalty," Stevens said.

The lead defense lawyer for accused Fort Hood shooter Maj. Nidal Malik Hasan said Monday that he believes the Army is violating Hasan's religious rights because it prohibited him from praying from the Koran in Arabic with a relative.
Attorney John P. Galligan said he learned that police guarding Hasan at Brooke Army Medical Center in San Antonio cut short a phone conversation Hasan was having with one of his brothers on Friday because Hasan was not speaking in English.
“Police at the hospital refused to let him pray, in Arabic, from the Quran with his brother,” Galligan said. “I think it's illegal and a violation of his religious rights.”
Hasan practices Islam, a religion whose followers hold that Jumu'ah (Friday) prayers are one of its most strongly affirmed duties. (Ed. Note: No kidding. Thanks for clearing that up, SF Chronicle)

How the Ft. Hood jihadi's terror imam got away - an update.

A Muslim cleric who communicated with the Army psychiatrist accused in the Fort Hood shootings was charged with passport fraud in Colorado in 2002. [...] U.S. Attorney David Gaouette (GOW-ette) in Denver said al-Awlaki was charged with passport fraud after a California agent discovered al-Awlaki lied on a 1990 Social Security application. The imam said he was born in Yemen, instead of Las Cruces, N.M., where he was born in 1971.
But federal prosecutors said Wednesday they dismissed the charge before the cleric, Anwar al-Awlaki, could be arrested because they learned the charge was invalid.
Here's how:

Here's why:
But after the charge was filed, Gaouette said, prosecutors discovered that al-Awlaki had corrected his place of birth with the Social Security Administration and that his passport application was therefore proper. A 10-year statue of limitations on charges of lying to the Social Security Administration had expired, so prosecutors had no case against the imam.
FYI - The reason he listed his birthplace as Yemen when he filed for this Social Security application? He wanted to be eligible for a foreign student visa. Now, why would he want to do that? FINANCIAL AID.
They discovered that the U.S.-born cleric attended Colorado State University in the early 1990's on an F-1 foreign student visa, stating on the visa application that he was actually born in Yemen and not New Mexico. This enabled authorities to charge Awlaki with passport fraud, a felony punishable by up to 10 years in prison.
Man, there is steam coming out of my ears, but you know what really ticks me off? If the charges were so invalid then why did the federal prosecutors in Colorado go on to say this?
And even if the passport charge had been pursued, a prosecutor who was among those who called for the dismissal says the imam was unlikely to face much jail time if convicted.
How much jail time according to recent Obama appointee, Gaouette? "Six months, at the most."
That's it? That's all they've got? You have got to be kidding me! File this one under Reason # 3989 that treating terrorists as ordinary criminals just does not work.

The Army has charged the suspect in the Fort Hood shooting spree with 32 counts of attempted premeditated murder.
The charges are in addition to the 13 premeditated murder charges filed against Maj. Nidal (Nee-DAHL) Hasan (Huh-SAHN') [Ed. Note: don't you just love the Washington Post with their little Muslim pronunciation keys?) in the Nov. 5 massacre at Fort Hood.

The Army wants a formal inquiry into the sanity of accused Fort Hood shooter Nidal Malik Hasan, Hasan's lawyer John Galligan told ABC News, and the request could be approved as early as Wednesday afternoon. [...] he received notice via e-mail at 7:45 p.m Tuesday that the Army would ask to convene a "sanity board" to evaluate Hasan's mental state.
According to Galligan, the e-mail said, "Given the magnitude and seriousness of the crimes alleged in the specifications, such alleged conduct makes me believe the accused lacks mental responsibility and capacity."
Okay, Hasan's lawyer is clearly playing all the angles, but doesn't it also sound like the Army is giving Hasan the bum's rush? To my way of thinking, the Sanity Board removes minimizes the Muslim angle and gives Hasan an easy out. It also takes some of the heat off Hasan's superiors. I don't know maybe I'm just getting cynical in my old age.
Galligan said he would like to "put the brakes on" until "we can be in receipt of all the evidence that a sanity board should properly consider before making its ultimate findings on this important issue."
"I'm concerned that the prosecution, by doing this at this juncture, is just trying to rush the procedure," said Galligan. "Normally these requests come from the defense, and I have never had one where the defendant is still in the ICU."
Galligan said he is also concerned about the composition of the "Sanity Board," since it would be likely to include Army psychiatrists. Major Hasan is himself a psychiatrist, and his alleged actions have raised questions about his training and about whether warning signs were missed by the Army's medical personnel.
Stay tuned. According to Mr. Galligan a determination on the Sanity Board could be made as early as this afternoon.

Ft. Hood Jihadi: Will likely plead not guilty by reason of insanity...

"I anticipate that the plea will be not guilty," said defense attorney John Galligan.
Asked if he was considering an insanity plea for his client, who faces 13 counts of premeditated murder, Galligan said, "I'm fairly confident that that's going to have to at least be examined. And that's problematic. But we haven't reached that stage yet."
Galligan said he has also learned that his client, who will be tried in a military court, may face additional charges for the Nov. 5 shooting spree in Fort Hood, Texas. He said he was alerted to the new charges during a pre-trial confinement hearing before a military magistrate held in Hasan's San Antonio hospital room Saturday.
More lawyering:
"In the 36 years I've dealt with military justice cases," Galligan said, "this is the first time I have ever had to go to an ICU to conduct a hearing. "We could have conducted this hearing next week. He is paralyzed. He is not going on leave." (For some reason this made me smile.)
Or is it complaining?
Galligan said he does not expect the Army to move his client from Brooke AMC immediately, but he does want to know when Hasan might be moved and where he might be moved. Hasan's official change in status from pre-trial restriction to pre-trial confinement, which was the subject of the Saturday hearing, also limits the number of people who can visit him.
"He is still a patient, but he is also a pretrial confinee," Galligan said. "There was not a compelling government interest to change his status at this time. "Given that condition, why is he anything but a patient?"
(Perhaps because he already shot up an Army base, killing 14 and wounding dozens? Just a wild guess. P.S. I hope the visitors he DOES get are thoroughly frisked for weapons or contraband.)

Still a little distracted today; so was the Ft. Hood Jihadi - about his HIV test.
Hasan was worried about results of recent HIV testing. Must have been all that lap dancing.
Major Nidal Hasan seemed worried about the results of an HIV blood test taken a week before the Fort Hood Shooting rampage, according to federal investigators piecing together background details on Hasan's life.
The information came from a member of the Fort Hood medical staff who was in the building where Hasan is accused of opening fire on November 5 and killing 13 people.
Speaking of lap dancing and the Ft. Hood Jihadi: I spent my morning listening to and freeping Senator Joe Lieberman's Hearing on the Ft. Hood Terror Massacre. FYI- only half of the senators on the Homeland Security and Governmental Affairs Committee managed to make the hearing. You can view the hearing in its entirety here.
And I have a prime example of that political theatre that Pres Obama was worried about when Senator Carl Levin brought up Rev Pat Robertson's statement on Islam. The senators and expert witnesses then proceeded to put Rev Robertson on trial with a vigor and venom they did not display against Hasan that's for sure. It was unbelievable.

AN AMERICAN, who seems normal but is driven by religious fanaticism, picks up a gun and kills 29 unarmed, innocent people.
This was not U.S. Army Major NidalMalik Hasan, who killed 13. It was Baruch Goldstein, who killed Muslim worshippers in a West Bank mosque in 1994.
I have no trouble calling Goldstein a religious extremist and a Jewish terrorist. He was widely and loudly condemned by almost all American Jews and Israelis.
Why should anyone pause before calling Hasan a religious extremist and an Islamic terrorist? He was apparently animated by religious belief; his business card carried the acronym SOA, for Soldier of Allah.
Not Uncle Sam. Allah.
The Council on American-Islamic Relations, America's largest Muslim civil-rights and advocacy group, denounced Hasan's alleged actions, but stopped short of calling him a "terrorist." In a brief interview Thursday, CAIR Executive Director Ibrahim Hooper told me that all the facts are not in.
I had follow-up questions, but Hooper begged off because of a heavy interview schedule.
In an interview Saturday, M. Zuhdi Jasser, president of the American Islamic Forum for Democracy, had no problem declaring Hasan's act "terrorism," which he called a symptom of the underlying cause, "political Islam."
The government has charged Hasan with 13 counts of premeditated murder, which means the government doesn't think he suddenly "snapped."...
At the Fort Hood memorial service, President Obama reminded America that this is a "time of war."
In a time of war, as we ask young men and women to die for America, we are entitled to ask questions of American Muslims without igniting a witch hunt. Questions are not accusations.
America has asked questions, and been answered, before.
In World War II, Japanese-Americans were wrongly rounded up and interned in camps. No one would dream of that for American Muslims.
Italian-Americans were sent to kill Italians, and they did. German-Americans were sent to kill Germans, and they did. The 442nd Regimental Combat Team, composed mostly of Japanese-Americans, took horrific casualties and served with extraordinary valor. They were "Americans first."
Can we count on the same from the roughly 3,500 Muslims who serve in our military, not to mention civilians? Some of Hasan's colleagues quoted him as saying he was a "Muslim first and American second," the London Telegraph reported, with Time adding that Hasan held Islamic Shariah law above the Constitution he had sworn to defend...

Military not told about Ft. Hood suspect's e-mails

Two high-profile anti-terrorism task forces did not inform the Defense Department about contacts between a radical Islamic cleric and the Army psychiatrist accused of killing 13 people in last week's rampage at Ft. Hood, a senior Defense official said Tuesday.
On the day of a memorial service for those killed at the Texas military base, the revelation compounded questions about whether the government had known enough in advance to stop the gunman.
The FBI and the Joint Terrorism Task Forces investigated e-mails that Maj. Nidal Malik Hasan sent over the last year to Anwar al Awlaki, an imam in Yemen who espouses a radical Islamist ideology and who has ties to militants. However, officials said, task force members concluded that the communications posed no threat and had been undertaken as part of Hasan's research on Muslims, the military and post-traumatic stress disorders.
Defense officials said Tuesday that the department did not learn about Hasan's contacts with Awlaki until after the Ft. Hood shootings. "There was no U.S. Army or other Department of Defense organization that knew of any contact he had with Muslim extremists," said the senior Defense official, who requested anonymity when discussing the ongoing investigation.
At least one of the task forces included a Defense Department investigator, who did not seek to share the intelligence with the military, officials said.
Various government agencies assign officials and investigators to the Joint Terrorism Task Forces. But there are strict rules about sharing information that is discussed or developed on a task force. "Any and all information from the task force . . . has to be approved by the FBI," the senior Defense official said.
Senior federal law enforcement officials acknowledge that approval is required from a joint task force supervisor, traditionally an FBI official, to share information from investigations with agencies.
In the case of the Hasan e-mails, however, the Pentagon investigator -- a member of the Defense Criminal Investigative Service -- agreed with the task force assessment that the psychiatrist did not pose a threat. The investigator did not press to bring the case to the military's attention.
"It just didn't get to that point," said a U.S. official, speaking on condition of anonymity when discussing the case. "They made the judgment that it did not rise to that level."

FORT HOOD, Texas — Pvt. Joseph Foster took a bullet in the leg during the Fort Hood shooting rampage. He pauses when he's asked about the mayhem, then credits a stout heritage with bringing him through the ordeal and leaving him eager for his scheduled January deployment to Afghanistan.
"I'm Irish. It hit the bone and bounced out," Foster, of Ogden, Utah, said Sunday of the bullet that tore into his left hip. His wife is uneasy about the deployment, but the 21-year-old Foster is resolute. "I'm a soldier. It's my job."

Across Fort Hood, signs point to a post on the mend after Thursday's shooting spree that killed 13 and wounded another 29. Accused gunman Maj. Nidal Malik Hasan, shot in the torso by civilian police to end the rampage, was in critical but stable condition and breathing on his own at an Army hospital in San Antonio.
Authorities continue to refer to Hasan, 39, as the only suspect in the shootings but they won't say when charges would be filed and have said they have not determined a motive.
Sixteen victims remained hospitalized with gunshot wounds, and seven were in intensive care.
Even as the community took time to mourn the victims at worship services on and off the post Sunday, Fort Hood spokesman Col. John Rossi said the country's largest military installation was moving forward with the business of soldiering. The processing center where Hasan allegedly opened fire remains a crime scene, but the activities that went on there were relocated, with the goal of soon reopening the center.
"There's a lot of routine activity still happening. You'll hear cannon fire and artillery fire," Rossi said. "Soldiers in units are still trying to execute the missions we have been tasked with."
President Barack Obama will attend a memorial service Tuesday honoring victims of the attack, amid growing suggestions that Hasan's superior officers may have missed signs that he was embracing an increasingly extremist view of Islamic ideology.
Sen. Joe Lieberman said Sunday he would begin an investigation into what the Army should have known about Hasan. A day earlier, classmates who participated in a 2007-2008 master's program at a military college said they complained to faculty about what they considered to be Hasan's anti-American views, which included his giving a presentation that justified suicide bombing and telling classmates that Islamic law trumped the U.S. Constitution.
"If Hasan was showing signs, saying to people that he had become an Islamist extremist, the U.S. Army has to have zero tolerance," Lieberman, an independent from Connecticut, said on "Fox News Sunday." "He should have been gone."
