The Justice Department is moving forward with criminal investigations relating to CIA interrogations of two detainees who died in the agency's custody.
The decision, announced Thursday by Attorney General Eric Holder, is the result of a nearly two-year preliminary review into the Bush-era interrogations by prosecutor John Durham. Though the secretive probe has drawn fierce criticism from Republicans since it began, Holder reiterated Thursday that he will not abandon it.
In a statement, Holder said the review looked mostly at "whether any unauthorized interrogation techniques were used by CIA interrogators, and if so, whether such techniques could constitute violations of the torture statute or any other applicable statute."
Though the review now triggers a full investigation into two deaths, Holder indicated Justice would drop its review of the other cases.
"Mr. Durham and his team reviewed a tremendous volume of information pertaining to the detainees. ... Mr. Durham has advised me of the results of his investigation, and I have accepted his recommendation to conduct a full criminal investigation regarding the death in custody of two individuals. Those investigations are ongoing," Holder said. "The department has determined that an expanded criminal investigation of the remaining matters is not warranted." ...
Rahman died in the early hours of Nov. 20, 2002 after being shackled to a cold cement wall in a secret CIA prison in northern Kabul, Afghanistan, known as the Salt Pit. He was suspected of links to the terrorist group Al Qaeda.
Al-Jamadi died in 2003 at the Abu Ghraib prison in Iraq. The death has been known to the public for years and a military autopsy declared al-Jamadi's death a homicide.

But the Sudanese captive, Ibrahim al Qosi, could serve far less time because his sentence is sharply limited in a plea agreement that remains secret.
Qosi pleaded guilty last month in the war crimes court at the Guantanamo Bay U.S. naval base to charges of conspiring with al Qaeda and providing material support for terrorism

(Reuters) - Around 25 former detainees from Guantanamo Bay camp returned to militancy after going through a rehabilitation program for al Qaeda members in Saudi Arabia, a Saudi security official said on Saturday.
The United States have sent back around 120 Saudis from the detention camp at the U.S. naval base in Cuba, set up after the U.S. launched a "war on terror" following the September 11 attacks by mostly Saudi suicide hijackers sent by al Qaeda.
Saudi Arabia, the world's top oil exporter, has put the returned prisoners along with other al Qaeda suspects through a rehabilitation program which includes religious re-education by clerics and financial help to start a new life.
The scheme, which some 300 extremists have attended, is part of anti-terrorism efforts after al Qaeda staged attacks inside the kingdom from 2003-06. These were halted after scores of suspects were arrested with the help of foreign experts.
Around 11 Saudis from Guantanamo have gone to Yemen, an operating base for al Qaeda, while others have been jailed again or killed after attending the program, said Abdulrahman al-Hadlaq, Director General of the General Administration for Intellectual Security overseeing the rehabilitation.

WASHINGTON — A suspected Al Qaeda organizer once called "the highest value detainee" at Guantanamo Bay was ordered released by a federal judge in an order issued Monday.
Mohamedou Ould Slahi was accused in the 9/11 Commission report of helping recruit Mohammed Atta and other members of the Al Qaeda cell in Hamburg, Germany, that took part in the Sept. 11, 2001, terrorist attacks.
Military prosecutors suspected Slahi of links to other Al Qaeda operations, and considered seeking the death penalty against him while preparing possible charges in 2003 and 2004.
U.S. District Judge James Robertson granted Slahi's petition for habeas corpus, effectively finding the government lacked legal grounds to hold him. The order was classified, although the court said it planned to release a redacted public version in the coming weeks.
Robertson held four days of closed hearings in the Slahi case last year.
"They were considering giving him the death penalty. Now they don't even have enough evidence to pass the test for habeas," said Nancy Hollander, an Albuquerque, N.M., attorney representing Slahi.
She said she could not comment further because the proceedings were classified. Slahi remains in detention at the U.S. facility in Guantánamo Bay, Cuba. The government may appeal, and on Monday Justice Department spokesman Dean Boyd said the Justice Department was "reviewing the ruling."
Brig. Gen. John Furlow, who helped lead a Pentagon-ordered investigation into detainee abuse at Guantanamo Bay, has testified that Slahi was "the highest value detainee" at the offshore prison and "the key orchestrator of the Al Qaeda cell in Europe."

We have since learned that the decision to mirandize Abdulmutallab had been made without the knowledge of or consultation with (1) the secretary of defense, (2) the secretary of homeland security, (3) the director of the FBI, (4) the director of the National Counterterrorism Center or (5) the director of national intelligence (DNI).
The Justice Department acted not just unilaterally but unaccountably. Obama's own DNI said that Abdulmutallab should have been interrogated by the HIG, the administration's new High-Value Detainee Interrogation Group.
Perhaps you hadn't heard the term. Well, in the very first week of his presidency, Obama abolished by executive order the Bush-Cheney interrogation procedures and pledged to study a substitute mechanism. In August, the administration announced the establishment of the HIG, housed in the FBI but overseen by the National Security Council.
Where was it during the Abdulmutallab case? Not available, admitted National Intelligence Director Dennis Blair, because it had been conceived for use only abroad. Had not one person in this vast administration of highly nuanced sophisticates considered the possibility of a terror attack on American soil?
It gets worse. Blair later had to explain that the HIG was not deployed because it does not yet exist. After a year!

President Barack Obama on Tuesday ordered the federal government to acquire the state prison in Thomson, Ill., and turn it into a high-security federal facility to house federal prisoners and about 100 Guantanamo detainees. The move is an important step in the president's effort to close the Guantanamo Bay prison, which administration officials now estimate may not happen until a year after the Jan. 22, 2010, deadline Mr. Obama set.
The prospect of moving terror suspects to an economically distressed Illinois village pits security concerns against the administration's promise of 3,000 new jobs in a rural corner of the president's home state, on the border with Iowa, about 145 miles west of Chicago.
"It's gonna help everybody out," said Todd Baker, the 43-year-old owner of Todd's Bait and Tackle in Thomson's small downtown strip. As he dispensed ice-fishing gear to a stream of customers Tuesday, Mr. Baker said only a few of his customers express safety worries. "They say terrorists are going to attack the prison or the trains or the nuclear plant or the dam. It's pretty much a maximum-security prison now. I'm not worried about that at all."

Obama administration officials plan on Thursday to tour a soon-to-be-shuttered Michigan state prison considered an option to hold terrorism suspects now detained at Guantanamo Bay in Cuba.
Two government officials said representatives of the Defense, Justice and Homeland Security departments would visit a state prison in Standish. The officials spoke on condition of anonymity because they were not authorized to speak publicly about the visit.
An Obama administration official said the visit was intended to gather information about the facility and no decisions had been made about where to move the detainees. Multiple options are being considered, said the official, who spoke on condition of anonymity because of the sensitivity of the discussions.
The maximum-security prison about 145 miles northwest of Detroit and the military penitentiary at Fort Leavenworth, Kan., are among the sites being considered to house the detainees if the prison in Cuba is closed by early 2010, as ordered by President Barack Obama.
Public pressure is mounting to do something to save the Standish prison, the region's largest employer with about 340 workers. Arenac County's unemployment rate already is 17.3 percent and the prison could soon close in a round of state budget cuts.
"If Standish Max becomes vacant, the impact would be devastating," said state Rep. Tim Moore, a Republican who represents the region in the Michigan Legislature. "Arenac County would be a ghost town."

Long after it was determined ? they make this sound like we Intentionally held them at Gitmo against their will ! These are some of the 60 to 100 detainees that were found to be not a real threat , yet when they were told they could leave , they had no country to go to ! Because no country would accept them !

HAMILTON (Reuters) - Hundreds of protesters called for Bermudian Premier Ewart Brown to step down on Tuesday and accused him of acting like a dictator in allowing four Guantanamo prisoners from China to settle on the mid-Atlantic island.
Some 600 people gathered outside Parliament in the island's capital Hamilton, waving banners and chanting "Brown must go" as they marched to the Cabinet office.
Brown emerged from the building and shouted to the booing crowd: "As some of you might know, I grew up in the protest era. This is nothing new to me. I have seen them larger and longer," he said.
Under an agreement with Brown, the United States last week sent to the British territory four members of China's Muslim Uighur minority who had been held at the Guantanamo prison camp long after the U.S. military and courts determined they posed no threat.
The United States said it could not send them to China because they faced persecution there, but U.S. politicians blocked efforts to release them in the United States.

If the detainees are relocated onto U.S. soil, "they'll be clamoring for their rights," said Randy Brogdon, an Oklahoma Republican state senator who is behind a resolution seeking to bar the detainees from Fort Sill in his state.
"Let's send them to the country they came from. The problem is, they won't take them back," he added.
That pretty much sums it up . What to do with 245 idiots that want to see the destruction of the United states !
Do we release them once they get here , because Many liberals And the new administration thinks it's a good gesture ?
Do we let them in our courts so they can clog up the system and eventually be released ? Costing taxpayers millions of dollars !!!!

CHICAGO (Reuters) - A cry of "not in my backyard" is growing louder over where to relocate terrorism suspects held at Guantanamo Bay once the military-run prison is closed.
"We're the new Guantanamo Bay if they move to Indiana and what does that mean for us?" said Republican state Senator Marlin Stutzman, who wants detainees kept away from the prison in Terre Haute, site of the federal execution chamber.
"Does it make us a target? I don't know how their (terrorism) networks work but I'm sure they keep track of where their buddies are at," he said.
Resolutions in a few states that are home to federal or military prisons call for the detainees to be sent anywhere but there, fearing those states will become magnets for terrorism.
Maybe we should put them in general population with our own worst of the worst , and see how they fair ?
Sixty of some 500 Guantanamo detainees previously released have been unable to leave because their home countries refuse to accept them, said Navy Commander J.D. Gordon, a Pentagon spokesman.
The military has tried to resettle them in third-party countries, but so far has had limited success, with a total of five Uighurs from restive western China sent to Albania in 2006.
"Congress has the authority to establish federal prisons and situate them. It's hard to see how a state can veto a particular prison," said Northwestern University law professor Robert Bennett. "There are plenty of dangerous people in these prisons without these prisoners from Guantanamo."
Out of 201,000 federal inmates, just 94 are jailed for violations of national security. Most of the rest were convicted of drug, weapons and immigration offenses, with some 12,000 serving sentences for murder, kidnapping or sex crimes.

The Otero county Facility In new Mexico Is right next door to the Jobsite I have been on for 9 month's !( McGregor Base Camp , New Amunition depot )It is almost fitting that they be detained within a mile Of where they house the types of weapons used against them before they were detained , And within 6 miles of where they train the Great U.S. Army to use these same weapons before they are shipped to Iraq and Afghanistan ! EL PASO -- While it is unknown where the 245 Guantanamo Bay prison camp inmates will be held when it shuts down in a year, it is possible some may end up one immigration detention center in El Paso and one just outside the city limits.
In his executive order to close Guantanamo in Cuba, President Barack Obama gave a task force 30 days to recommend policies on where Guantanamo detainees should be housed once it closes, and how terror suspects held in the future will be handled.
The El Paso Processing Center, which is operated by Immigration and Customs Enforcement, or ICE, can hold up to 840 detainees. On Thursday, the El Paso center, which is near the airport, had 760 detainees.
The Otero County Processing Center, which is in New Mexico outside of the Northeast El Paso city limits, has room for 1,000 detainees. It is privately owned and contracts with ICE and other federal agencies. The center had 768 ICE detainees Thursday.
All detainees at the two centers are suspected of violating immigration laws and are either awaiting trial or deportation.
"On any given day, you will find people there from every country in the world," ICE spokeswoman Leticia Zamarripa said.
If needed, ICE also has contracts with 68 other jails and detention centers in the El Paso-New Mexico region that can house immigration detainees.
U.S. Rep. Silvestre Reyes, D-Texas, House Permanent Select Committee on Intelligence chairman, said he supports President Obama's decision to close Guantanamo.
"The military prison at Guantanamo Bay has become a symbol for the previous abuses and mistreatment of detainees, and I fully support efforts to close the facility," he said. "Today's actions by President Obama are important first steps in working to provide America's Intelligence Community with the tools and resources they need to keep America safe, and at the same time restore the United States to its proper place as a leader in the respect for human dignity and rights."
