After reading the article it seems like the school did not single out Omar Elgammal because of his religion. It seems like they singled him out because he's a trouble maker.
The lawsuit is not actually about discmination, it's about scaring other institution into treating muslims differently then every one else. How many other lawsuits have there been like this one? Countless. Canadian Press
Omar Elgammal is suing the Toronto French School, headmaster John Godfrey - who was first elected to the House of Commons in 1993 - and principal Heidi Gollert over alleged remarks at a school assembly denouncing the teen after a fight apparently sparked by racial slurs.
in the defamation lawsuit filed in Ontario Superior Court, Elgammal alleges that on Oct. 23, 2008, a student from another private school was at Toronto French School and insulted Elgammal.
The student "seized" upon Elgammal's Muslim heritage, calling his father "bin Laden," calling them terrorists and saying, "What are you guys going to do, call out, 'Allah, Allah, Allah, Allah, Allah?" Elgammal alleges.
Elgammal also says the student then made the gesture of pushing a hand-held detonator. The lawsuit alleges the student had racially taunted Elgammal and another TFS student on other occasions, calling Elgammal's friend's Filipina mother "a maid."[...]
Godfrey, who left politics last summer to take the headmaster job, and Gollert convened an assembly on Nov. 3 and told those gathered that "some of our students" - whom Gollert described as "attackers" - taunted a student visitor to the school and assaulted him, Elgammal alleges.
Godfrey also referenced the Holocaust, apparently using it as a historical comparison for the role the student body should play when faced with the actions of a "thug," "bully" or "bad person," the lawsuit says.

Finally, someone sees past the stupid race issue. He was a trouble maker, who had a very long and serious disciplinary history.
It is also ironic that he uses other forms of defamation to push his case...
